These Terms of Use ("Terms") govern your access to and use of AVA 3D, including the mobile application, related websites, and healthcare professional portal (collectively, the "Services"), operated by Aesthetic Vision Inc. ("Company," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
The Services enable adult users to create 3D scans of certain body areas, store and manage those scans, and share selected scans with healthcare professionals chosen by the user for information exchange and communication purposes only.
The Services are a non-medical technology platform for scan capture, storage, management, and transmission.
The Company acts as a controller for the operation of the Services. In certain contexts, the Company may act as a processor on behalf of healthcare professionals.
2. Eligibility
You must be at least 18 years old to use the Services.
By using the Services, you represent and warrant that:
  • you are at least 18 years old;
  • you have legal capacity to enter into these Terms;
  • the information you provide is accurate and current.
3. Account Registration
To use certain features, you must create an account and provide required registration information.
You agree to:
  • provide accurate, complete, and up-to-date information;
  • keep your login credentials confidential;
  • promptly notify us of any unauthorized access or suspected security incident;
  • be responsible for activities occurring under your account unless prohibited by law.
We may require identity, email, or healthcare-professional-account verification for certain features or users.
4. User Scans and User Responsibility
You retain responsibility for the scans and content you create, upload, store, or share through the Services ("User Content").
You represent and warrant that:
  • you have all necessary rights and permissions to create, upload, store, and share the User Content;
  • the User Content does not violate applicable law or the rights of any third party;
  • if a scan or image contains another person or another person's body data, you have obtained all legally required consents and permissions.
You understand that scans may contain highly sensitive personal information.
5. Sharing with Healthcare Professionals
The Services allow you to share selected scans with specific healthcare professionals designated by you.
By sharing a scan with a healthcare professional, you instruct us to provide that healthcare professional access to the selected scan through the Services.
You may revoke access through the Services. Revocation will remove future access through our portal, but may not affect:
  • copies already downloaded, exported, or retained by the healthcare professional;
  • clinical records or documentation independently created or retained by the healthcare professional;
  • disclosures required by law or professional obligations applicable to the healthcare professional.
We are not responsible for the independent actions, medical judgments, recordkeeping practices, or legal obligations of healthcare professionals.
Healthcare professionals act independently and are solely responsible for compliance with applicable medical, professional, and data protection laws.
6. Healthcare Professional Accounts
We may permit healthcare professionals to register for healthcare professional portal access, subject to review, approval, verification, suspension, or removal at our discretion.
Approval of a healthcare professional account does not constitute:
  • a recommendation or endorsement;
  • a warranty of qualifications;
  • a representation regarding licensing, competence, or suitability.
Users are responsible for selecting the healthcare professionals with whom they share scans.
7. Intended Use and Restrictions
The Services are intended solely for visualization, documentation, and communication purposes.
The Services are not intended for medical purposes, including but not limited to diagnosis, prediction, prognosis, prevention, treatment, simulation of medical outcomes, surgical planning, or influencing clinical decision making.
Users, including healthcare professionals, are strictly prohibited from using the Services for any such purpose.
Any information, communication, or interaction facilitated by the Services is for informational and transmission purposes only.
The Services do not influence or support clinical decision making.
Do not use the Services for emergencies. If you believe you are experiencing a medical emergency, contact local emergency services immediately.
8. License and Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose.
You may use the Services only in compliance with applicable law and these Terms.
9. Prohibited Conduct
You may not:
  • use the Services if you are under 18;
  • upload, create, transmit, or share scans of another person without their legally valid consent;
  • impersonate another person, healthcare professional, or entity;
  • misrepresent your identity, credentials, or professional status;
  • use the Services for unlawful, fraudulent, abusive, or harmful purposes;
  • attempt to gain unauthorized access to any account, scan, system, or network;
  • interfere with the integrity, security, or performance of the Services;
  • upload malware, malicious code, or harmful content;
  • copy, scrape, harvest, reverse engineer, decompile, or otherwise exploit the Services except as permitted by applicable law;
  • bypass, disable, or circumvent access controls or technical protections;
  • use the Services to store or distribute content that infringes privacy, publicity, intellectual property, or other rights;
  • use the Services to provide emergency, diagnostic, or treatment services through the platform itself;
  • resell, sublicense, or commercially exploit the Services except as expressly authorized by us.
10. Privacy and Data Protection / GDPR Awareness
Your use of the Services is also subject to our Privacy Policy, which explains how we process personal data.
You acknowledge that the use of the Services may involve the processing of personal data, including special categories of personal data within the meaning of Article 9 of the General Data Protection Regulation (GDPR), such as biometric data derived from 3D scans of body areas.
The Company processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the GDPR.
User Responsibility for Lawful Use and Sharing
You are solely responsible for ensuring that your use of the Services, including the creation, upload, storage, and sharing of User Content, complies with applicable data protection laws.
In particular, you represent and warrant that:
  • you have a valid legal basis under Article 6 GDPR for any processing of personal data you initiate;
  • where required, you have obtained explicit consent under Article 9 GDPR for the processing and sharing of biometric or other special categories of personal data;
  • if User Content contains personal data of another individual, you have provided all legally required notices and obtained all necessary consents from that individual;
  • any sharing of User Content with healthcare professionals or other third parties is lawful and permitted under applicable data protection laws.
Independent Controllers
Healthcare professionals who receive access to User Content through the Services act as independent data controllers with respect to any personal data they access or process. They are solely responsible for their own compliance with applicable data protection, medical confidentiality, and professional obligations.
No Responsibility for Third-Party Processing
The Company does not control and is not responsible for the processing of personal data by healthcare professionals.
The Company acts as a controller for the operation of the Services.
In certain contexts, the Company may act as a processor on behalf of healthcare professionals.
11. Intellectual Property
The Services, including their software, design, text, graphics, trademarks, logos, and other content other than User Content, are owned by or licensed to us and are protected by applicable intellectual property laws.
Except for the limited license expressly granted in these Terms, no rights are granted to you.
12. Feedback
If you provide suggestions, ideas, feedback, or recommendations regarding the Services, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use and incorporate that feedback without restriction or compensation to you.
13. Service Availability and Changes
We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice, subject to applicable law.
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
14. Suspension and Termination
We may suspend or terminate your access to the Services if:
  • you violate these Terms;
  • we reasonably suspect fraud, abuse, security risk, or unlawful activity;
  • we are required to do so by law;
  • continued access could harm us, the Services, healthcare professionals, users, or third parties.
You may stop using the Services at any time. Termination does not affect rights or obligations accrued before termination.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
  • THE SERVICES WILL MEET YOUR REQUIREMENTS;
  • THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • ANY SCAN, TRANSMISSION, STORAGE, OR ACCESS OPERATION WILL BE FREE FROM LOSS, DELAY, OR FAILURE;
  • ANY HEALTHCARE PROFESSIONAL WILL REVIEW, ACCEPT, OR RESPOND TO A SHARED SCAN;
  • ANY CONSULTATION RESULT WILL BE SUITABLE, ACCURATE, OR MEDICALLY APPROPRIATE.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED [AMOUNT OR FORMULA].
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Aesthetic Vision Inc., its affiliates, and its respective officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to:
  • your User Content;
  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law or the rights of a third party.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of Germany, excluding conflict-of-law principles, unless otherwise required by applicable consumer protection law.
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Germany, unless applicable law provides otherwise.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the updated Terms, to the extent permitted by law.
